Privacy Policy

Last updated: September 24, 2026

This Privacy Policy explains how GemShop LLC (“GemShop”, “we”, “us”) collects, uses and protects your personal information when you visit gemshopco.com, place an order or contact us. For the purposes of data protection laws, including the EU and UK General Data Protection Regulation (GDPR), GemShop LLC is the controller of your personal information.

1. Information we collect

  • Order and contact details: name, email, phone number, billing and shipping address.
  • Personalization content: the photos and texts you upload or send us to make your piece. Photos may show you or other people.
  • Payment information: processed by Shopify and our payment providers (such as card processors and PayPal). We never see or store your full card number.
  • Order history and communications: products purchased, messages you send to our support, reviews.
  • Device and usage information: IP address, device and browser type, approximate location (country or city derived from the IP address), pages viewed, clicks, and how you arrived at the Site, collected through cookies and similar technologies (see our Cookie Policy).

2. How we use it, and on what legal basis

  • To produce, ship and support your order, including your photo and text, tracking notifications and requests under our guarantee (performance of the contract).
  • To prevent fraud and keep the Site secure (our legitimate interest and legal obligations).
  • To send you marketing emails, only if you subscribed, and to enter you in the monthly prize draw if you confirmed your subscription (your consent). You can unsubscribe at any time with the link in every email.
  • To measure and improve the Site, including analytics and session recordings that show how visitors navigate our pages (our legitimate interest in running a working, secure store; you can object at any time).
  • To show you relevant ads on platforms such as Meta (Facebook, Instagram) and Google, and measure their results (our legitimate interest in promoting our products; you can object at any time, see our Cookie Policy).
  • To comply with the law, including tax, accounting and consumer protection obligations (legal obligation).

3. Your photos

We use your photos only to make your order and to handle any remake under our guarantee. We do not use them in advertising, on social media or to train any model, and we never publish them without your explicit permission. They are shared only with the partner that produces your piece. We keep them for as long as needed to complete your order and your guarantee period, and you can ask us to delete them at any time after delivery. Please only send photos you have the right to use (see our Terms of Service).

4. Who we share information with

We do not sell your personal information for money. We share it only with service providers who help us run the store, under contracts that protect it:

  • Shopify (store platform, checkout and payments) and payment providers;
  • our production partner, which makes and packs your piece (photo, text and shipping details);
  • shipping carriers and our order-tracking provider;
  • email marketing, reviews, customer support, analytics and session-recording providers;
  • advertising partners such as Meta and Google, for ad measurement and targeting;
  • authorities, when required by law, and professional advisers or a buyer of our business, if applicable.

Sharing data with advertising partners for targeted ads may be considered a “sale” or “sharing” under some US state laws. You can opt out as described in section 7.

5. International transfers

We are based in the United States, and our service providers may process data in the United States and other countries. When personal information from the European Economic Area, the United Kingdom or Switzerland is transferred abroad, we rely on appropriate safeguards, such as the European Commission’s Standard Contractual Clauses or equivalent mechanisms.

6. How long we keep it

We keep order information for as long as required by tax and accounting laws (usually up to 10 years), marketing data until you unsubscribe or ask for deletion, and personalization photos as described in section 3. Other data is deleted or anonymized when it is no longer needed.

7. Your rights

Depending on where you live, you may have the right to access, correct, delete or receive a copy of your personal information, to restrict or object to its use, to withdraw your consent at any time, and to opt out of targeted advertising or the “sale” or “sharing” of your personal information. We do not discriminate against you for using these rights.

To use any of these rights, email support@gemshopco.com. We may need to verify your identity, and we answer within the time required by law (usually 30 days). If you live in the EU, UK or Switzerland, you can also complain to your local data protection authority.

8. Security

We use appropriate technical and organizational measures to protect your information, including encrypted connections (HTTPS) and a checkout hosted by Shopify. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.

9. Children

The Site is not intended for children, and we do not knowingly collect information from anyone under 16. If you believe a child has sent us personal information, contact us and we will delete it.

10. Changes to this policy

We may update this policy from time to time. The date at the top shows the latest version. Significant changes will be highlighted on the Site.
